There are lot of people whodo investments,have kids and buy houses and everything else when they are on H1.
I don't see any reason to hold off things on H1. If your wife did master's why don't get her on H1, there are so many job openings available in market.
Instead of crying, take some action
She has been trying for the past 5 years... She is not in IT. She would get past all the interview processes etc but when it comes to finalizing the papers with HR etc comes the final blow. "No visa sponsorships, Sorry !! "
Seeing all her friends climb up the ladders.. doing well in different areas and you being left helpless is difficult to digest. She has been volunteering, working with different Societies, charity organizations. But keeping yourself busy is not just what she wants to do.

So yes I have a masters and my old company forced me into EB3. If it would have been just that easy that there was 150000 new jobs out there where i could have gone and filed under EB2 I would have. But guess what for most of us it was/is not, especially now. I do not know anyhting about the so called top companies you mention or the Desi ones. I am no computer science major, and I am sure not all of us here are. So please before you make it sound like it is so simple cus it's America, live a few days in someone elses shoes first and then talk. I dont go around and say hey well why didnt you get born in another country... we all are in our own shoes, and understanding someone elses will broaden your horizon and make you less likely to judge people, so try it :-)

Agree.. Most of the Top companies file based on the skill set and Qualification and do file EB2 for people who satisfy that requirement. Its the Desi consulting companies who do all the crappy stuff on earth.
Top companies file EB2 for M.S Degree holders and thats what the law says. If one employer does not file under EB2 even after you are eligible for it move to another one. If you have the correct skillset you should be able to find another job.

My frined got receipt from TSC yesterday, his attorney sent package them on 31st , I think they got it on June 1st. He has not got finger printing notice yet.
I applied on May 18th 140/485 Nebraska, Got receipt on May 28 from TSC with finger printing schedule after 2 weeks. 140 got approved on 23rd May.
Friends, My friends is saying if the New bill approves then we might have to re-apply again, even wealready have applied 485, is this True? I am bit confuse, I aksed to my Lawyer he said your Labor and 140 is New , he cannot tell anything at this point. If the person is already applied and waiting for Card should be effected, any opinion?

I am in the same situation in that I too have not received my FP notice as yet. Filed July 23rd at TSC. The application was transferred to CSC and then back to TSC. I opened a SR on October 5th and still have not received a FP notice. When I called to follow up, I've was told that the TSC is significantly delayed because of the volume of applications they received and to wait 90 days!
For those of you who have used infopass, was it helpful in getting your FP scheduled?
Also, can the person who wrote to the obudsman post the e-mail address and format of what he/she wrote? This would make it easier for those of us who would also like to send an e-mail.

Write letters to Ombudsman, USCIS, DHS, Senators. Keep writing until they listen
Somebody gave a red at "05:13 AM" with comments: "letters..stupid idea?" - I am not here to become famous and become IV-CEO or something :-) so red does not matter. This is height of someone's frustration though ...instead of coming up with some idea - just criticize other's ideas..and that too at 5AM in the morning (or around that time in different timezone)..you must be a manager dude :D

Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...

Many of the eb3 245i cases; there dependents were outside USA. Once; they got greencards; then their dependents went for consular processing or are going for consular processing.

I understand we want to stand alone with our issues and that may be favourable to us from an anti-immi stance taken by many in Govt and otherwise. I am not sure though if by alienating EB retrogression issue with H1B increase we will be able to get anything done.
Our main supporters are teh corporations who hire us and want us to be perm. There bigger concern right now is getting more people who can hired on H1B. Unless we threaten mass exodus, I do not think we stand a chance if we try to run alone with only EB retrogression issue.
People (Senators aginst CIR or SKILL and even NUmbers USA) may say that OK we are not against you folks, but the point is will those same people do something about our predicament if this was the only thing on the table, I dont think so.

For people who have already landed and were not able to get a PR card applied, please follow the following link and apply for it.

Hi - I currently have my H1B(H4 for my wife) valid till Mar 2011 and EAD expires on 10/15/08.
Can I skip the renewal process for now and apply for EAD later?
My lawyer says it is OK to skip for now and apply for EAD/AP anytime as long as I-485 is pending.
Please advise.
